Jhon Shovon Gomes Mr. Saikat Basu Mr. Debraj De ....for the petitioner Mr. Debdipto Banerjee Mr. Soumen Banerjee ....for the opposite party This application under Article of the Constitution of India is at the instance of the wife praying for a direction upon the learned Additional District Judge, Fast Track, 1st Court at Sealdah to dispose of Matrimonial Suit No.30 of 2019 expeditiously. The learned advocate appearing for the petitioner submits that the husband/opposite party herein is avoiding to appear for reconciliation.
The learned advocate appearing for the opposite party submits that he has entered appearance in the said suit and is ready and willing to appear for reconciliation on the next date fixed.
The learned advocate appearing for the petitioner submits that an application under Section 151 of the Code of Civil Procedure filed by the petitioner is pending.
The learned advocate appearing for the opposite party submits that a written objection to such application has already filed.
It has been uniformly submitted by the learned advocates for the respective parties that September 22, 2025 has been fixed for reconciliation. The parties have assured this Court that they shall appear for reconciliation on the next date fixed before the leaned trial judge.
In the light of the submission made by the learned advocates for the respective parties, CO 2417 of 2024 stands disposed of by requesting the learned Additional District Judge, Fast Track, 1st Court at Sealdah to make an endeavour to dispose of interlocutory applications as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the interlocutory applications the learned trial judge shall make an endeavour to dispose of the matrimonial suit expeditiously, if the reconciliation fails. There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
