It is submitted on behalf of the petitioner that as an alleged land loser, the petitioner is entitled to such appointment and the respondent Corporation is wrongfully denying the petitioner such employment. On behalf of State respondent, it is submitted that the entire claim of the petitioner is suspicious and meritless. It is further submitted on behalf of the State respondents that on the basis of a query raised by the respondent no. 1, all the factual details as alleged by the petitioner are highly debatable and require an elaborate investigation. For example, at the time of issuing of the 'patta', the petitioner was two years old.
In view of the submissions made on behalf of the parties, it is obvious that there are serious factual disputes pertaining to the entire claim of the petitioner, which go to the root of any purported entitlement which the petitioner may have been entitled to. The pre-conditions for obtaining any employment as a land loser requires an elaborate factual enquiry.
At this stage, on the basis of the alleged documents relied on by the petitioner, the petitioner has been unable to demonstrate any enforceable legal right or entitlement to employment.
In view of the above, there is no merit in the present writ petition.
WPA 16488 stands dismissed as not maintainable.
