One of the Judges (Tirthankar Ghosh, J.) who is a member of the Larger Bench had made the referencce. Another Judge of the Bench (Joymalya Bagchi, J.) is a party to some of the judgments which are in conflict with other judgments referred to in the reference.

Under such circumstances, the parties were called upon to express their views with regard to the composition of the Bench. The parties clarified that they do not have any objection with the composition of the Bench.

Accordingly, the Bench proceeded to take up the reference for hearing.
