Mr. Sakti Pada Jana Mr. Subhajyoti Das ........for the petitioner Mr. Suddhadev Adak .......for the State Mr. Tarun Kumar Das .......for the respondent nos. 4 and 5 Petitioner has come up with this writ petition praying for grant of approval of his service as Assistant Teacher in Shree Balkrishna Vithalnath Vidyalaya, Kolkata which is a DA getting school. It has been submitted on behalf of the petitioner that initially petitioner was appointed as Assistant Teacher in Physical Education with effect from 12th December, 2012 and in the meantime petitioner has acquired training qualification, i.e.

and subsequent thereto the aforesaid school authority has forwarded the proposal to the District Inspector of Schools (SE), Kolkata being the respondent no. 3 for according approval of appointment which would make the petitioner

entitled to receive Dearness Allowance from the State Government.

In this regard, reliance is placed on a document which is at page 25 of the writ petition wherefrom it appears that proposal was forwarded on 29th March, 2022 but till date no decision has been taken by the respondent no. 3.

On behalf of the school authority and the State respondents it has been submitted by the learned advocates that previously proposal of the school authority was rejected by the respondent on 3 on the ground that petitioner was not having training qualification.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of by directing respondent no. 3 to take decision on proposal of the aforesaid school authority for granting approval of appointment in favour of the petitioner by six weeks from the date of communication of this order after granting opportunity of hearing to the school authority and the petitioner or their representatives. The decision to be taken by the respondent no. 3 shall be communicated to the parties by one week thereafter.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
