Learned advocate for the petitioner submits that he has been subjected to obstruction at the behest of the private respondents for cultivating the land.
Petitioner alleges that in spite of informing the police authorities no steps have been taken. Learned advocate appearing for the private respondents, on the other hand, submits that earlier between the self-same parties another writ petition was preferred and it has been categorically observed therein that since the civil suit is pending between
the petitioner and the private respondents and the civil court is already in seisin of the issue, so far as the right, title and interest of the property is concerned, the same would be considered by the civil court.
Police authorities have drawn up proceedings under section 126 of the BNSS. They would continue their surveillance and ensure that no breach of the peace and tranquility takes place. With the aforesaid observations WPA 16455 of 2025 is disposed of.
