This is an application filed under Section 401/482 of the Code of Criminal Procedure praying for quashing of the order dated 02.12.2009 passed by the learned Judicial Magistrate, 1st Court, Malda in Misc. Case No. 445M/08 and Misc. Case No. 61(M) of 2011. In terms of the impugned order dated 2.12.2009 the Trial Court ordered payment of maintenance by the petitioner to the opposite party/wife to the tune of Rs.600/- per month and Rs.300/- each of the two minor children per month as per English Calendar month.

On perusal of the application, the impugned Order and other materials on record, it appears that exercise of jurisdiction under Section 482 read with Section 401 of the Code of Criminal Procedure is unwarranted.

Accordingly, the instant revisional application stands dismissed on merit.
