Heard learned counsels for the parties.
The petitioner was granted bail by this Court on 26th August, 2022. The petitioner failed to appear before the learned trial Court for which warrant of arrest was issued against him. He surrendered before the learned trial Court on 4th March, 2025. His bail prayer was turned down by the learned trial Court. He has been in custody since then. He undertakes not to misuse the liberty henceforth. Opposing the prayer, learned counsel for the State submits that the petitioner is a resident of Uttar Pradesh and may abscond if released on bail at this stage. About 50 witnesses have been examined so far.
In view of the fact that the petitioner was granted bail earlier and undertakes not to misuse the liberty henceforth, this Court is of the view that further detention of the petitioner is not required and he may be released on bail subject to stringent conditions. Accordingly, prayer for bail is allowed.
The petitioner namely Raju Jaiswal be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Paschim Medinipur subject to the condition that he shall reside at the address in Kolkata given in the cause title of the application and shall appear before the learned trial Court on every date of hearing. He shall not intimidate witnesses or tamper with evidence in any manner whatsoever. He shall not leave the jurisdiction of Rajabagan Police Station till conclusion of trial. In the event the petitioner fails to adhere to any of the conditions stated above, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
