Special leave to appeal has been filed owing to the judgment and order of acquittal passed by the Judicial Magistrate, 5th Court, Serampore, Hooghly on 30.06.2023, whereby learned Magistrate acquitted the opposite party No.2 of the charge under Section 138 of the Negotiable Instruments Act. After hearing learned advocate appearing on behalf of the appellant as well as on careful perusal of the judgment, the prayer for Special Leave to Appeal is allowed. Thus, leave is granted to the petitioner to file appeal within the statutory period.
