CRM 7253 of 2021 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak Police Station Case No. 88 of 2020 dated 29.1.2020 under Sections 489B/489C/120B of the Indian Penal Code subsequently charge sheet submitted under Sections 489B/489C/120B/34 IPC.

This is the third application for bail by the petitioner seeking release on bail inter alia on the ground that the petitioner is languishing in jail for last 530 days and that no fake currency note was recovered from his possession and the accused from whom, the fake currency was recovered and seized under seizure list has already been granted bail. Learned Advocate for the State raised objection and pressed in service the Case Diary to submit about the involvement of the petitioner in the case under reference.

Having heard learned Advocates for the parties and on perusal of case diary in view of the report and considering the nature and gravity of the offence, the prayer for bail is considered and rejected.

Thus, the application being C.R.M. 7253 of 2021 is dismissed, however, since the charge sheet has already been submitted, learned Trial Court is requested to expedite the trial. (Ananda Kumar Mukherjee, J.) (Shivakant Prasad, J.)
