The petitioner complains that notwithstanding order of injunction and police help passed by the Civil Judge (Junior Division), 1st Court, Diamond Harbour, South 24-Parganas in Title Suit No.116 of 2016 the respondents have continued to harass the petitioner and disturb her peaceful possession.

It is submitted that the trial has commenced in the suit. The private respondents are still stated to be harassing the petitioner.

Counsel for the State submits instructions of the IC Raidighi Police Station, Sundarban Police District and the same is taken on record.

It appears that on the complaint of the petitioner FIR was registered and charge sheet being Raidighi PS Case No.304/19 dated 30.08.2019 under Sections 447/341/188/427/506/34 of the IPC has been filed. Further complains from the petition's husband has also been taken cognizance of and resulting in

charge sheet being Raidighi PS Case No.345/19 dated 26.09.2019 against the private respondents.

Police have also taken up prosecution under Section 107 of the Cr.P.C. on at least three occasions against the private respondents.

There is clear evidence before this Court that the private respondents are harassing the petitioner. The Civil Court has already ordered police protection. The Officer-in-Charge, Raidighi Police Station shall inspect the said area and consider posting of a police picket outside the petitioner's residence at the cost of the petitioner.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
