Patra Ms. Supriya Dubey ......For the SSC The School Service Commission wanted to know from the District Inspector of Schools (S. E.), South 24 Pgs. about the vacancy available in the district of 24 Parganas. Today the District Inspector of Schools have come up with a report in the form of an affidavit wherefrom surprisingly it is found that two vacancies in the two schools named in paragraph 8 of the writ application also are existing (emphasis mine). Therefore, I do not find any impediment for the School Service Commission to recommend the petitioner in the first named school in paragraph 8 of the writ application and also in paragraph 4 of the report of the D. I. i.e. Gandhabaduli Aghore Kamini Institution ( H. S.), Vill. & P. O. Gandhabaduli, P. S. Bishnupur, District- South 24 Parganas. Such

recommendation is to be made by the School Service Commission in favour of the petitioner within a period of three weeks from date of communication of this order. These two schools, namely, (i) Gandhabaduli Aghore Kamini Institution ( H. S.) and (ii) Chack Chatta S. B. High School ( H. S.) which is also named as per the report of the D. I. shall not be filled up for a period of eight weeks excepting recommending and appointing the petitioner in the first named school. After recommendation of the West Bengal Central School Service Commission by three weeks, the Board will send the appointment letter to the petitioner to the above named school by three weeks thereafter. After the above eight weeks period the interim order, as to not filling up the post of teacher in Chack Chatta S. B. High School (H. S.) shall be inoperative in every respect and it can be included in the subsequent vacancy list.

The report in the form of an affidavit filed by the District Inspector of Schools, because of the prompt action on the part of the learned State Advocate Mr. Arindam Chattopadhyay which is appreciated by this court, is kept on record.

With the above direction and observation the writ application is disposed of.
