And In Re : Souraprasanna Das ..... petitioner Mr. Devajyoti Barman Ms. Sanjukta Basu Mallick .... for the petitioner Mr. Bivas Chatterjee ... for the State The petitioner is apprehending arrest in connection with Howrah Cyber Crime Police Station Case No. 47 of 2020 dated 24.12.2020 under Sections 419/468/420 of the Indian Penal Code, 1860, the petitioner is seeking anticipatory bail. Mr. Devajyoti Barman learned advocate for the petitioner submits that the petitioner has cooperated with the investigation pursuant to notice issued under Section 41A of the Code of Criminal Procedure and there is nothing against the present petitioner.

Mr. Bivas Chatterjee, learned advocate for the State submits that the Charge-sheet has been submitted in connection with the above referred case but the petitioner has not sent up as an accused.

Therefore, question of apprehension of arrest does not arise in connection with the case as per the case diary and the charge-sheet.

Having heard both parties and in consideration of Chargesheet placed in case, the application for anticipatory bail being CRM 7264 of 2021 is considered and rejected as infructuous. (Krishna Rao, J.) (Shivakant Prasad, J.)
