In re: CAN 1 of 2022 This is a restoration application, being CAN 1 of 2022, for recalling the order of dismissal for default of the writ application being WPA 17594 of 2021 which was dismissed for default on 14.03.2022.
In this restoration application sufficient cause has been shown and the order of dismissal for default is recalled and the writ application is restored in its original file and number.
The application being CAN 1 of 2022 is disposed of.
WPA 17594 of 2021 In this matter the petitioner applied for transfer through Utsoshree portal which came into force for transfer of teachers from one school to another. Pursuant thereto the School Service Commission wrote a letter to the District Inspector of Schools (SE), South 24 Parganas to intimate them about the vacancy status by the Commission's letter dated 14.08.2019. However, this letter is only one letter seeking information which does not create any right in favour of the petitioner for being transferred on the basis of this letter or any reply to this letter of the Commission dated 14.08.2019.
From August, 2021 a procedure for transfer of teachers namely Utsoshree portal has come into effect and the petitioner is to apply through Utsoshree portal now for his transfer and his application for transfer will be taken care of according to the Utsoshree portal and the present rules and Government orders for transfer. This court is not inclined to run a parallel system beside Utsoshree portal for transfer of teachers by passing any order of transfer.
With the above observation and direction, the writ application is disposed of.
