Heard Ms. Chakraborty, learned counsel appearing on behalf of the petitioners and Mr. Bhattacharyya, learned senior Counsel representing the opposite party.
This revisional application was filed assailing the judgement passed by the learned Additional District Judge, 14th Court at Alipore in Misc. Appeal No. 77 of 2012. The matter is awaiting adjudication for last nine years.
It is submitted by Ms. Chakraborty, that considering the age of the proceeding necessary direction may be given to the learned Trial Court for expeditious disposal for the suit itself. Mr. Bhattacharyya, learned senior counsel does not oppose such prayer.
Under such circumstances, I am inclined not to interfere with the order impugned.
Learned Trial Court is directed to take all possible steps to secure the rights of the parties to have speedy disposal. However, it is requested that while giving adjournment, learned Trial Court is requested not to grant any prayer for adjournment,
if made by either of the parties unless there is compelling situation or circumstance.
The revisional application is thus disposed of along with application being CAN 1 of 2015.
Let a copy of the order be sent down to the learned Trial Court for information and necessary action.
