By an order passed on December 20, 2022 in W.P.A. 26600 of 2022 this Court directed the concerned respondent to consider and dispose of the application submitted by the petitioner for grant of contract carriage permit for plying auto rickshaws subject to the petitioner submitting such application in prescribed form along with prescribed fees.

Learned counsel for the petitioner submits that though the application submitted by the petitioner has been received by the authority, the prescribed fees which the petitioner intends to deposit is not being accepted by them. The petitioner seeks direction upon the concerned authority to accept the requisite fees in connection with the application filed by the petitioner and dispose of the application at the earliest. Learned counsel for the respondents submits that the 3rd respondent be directed to accept the prescribed

fees and the 2nd respondent be directed to dispose of the application in accordance with law.

In view of the above, the writ petition is disposed of directing the 3rd respondent to accept the requisite fees to be submitted by the petitioner within 7 days from date. Since the application in prescribed form has already been submitted by the petitioner, the 2nd respondent is directed to consider and dispose of the same within one month from the date of receipt of the requisite fees from the petitioner upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
