The application for mutation filed by the petitioners online before the Baranagar Municipality is pending consideration at the end of the Municipality since 6th September, 2022.
The Municipality has not intimated the petitioners the reason(s) for withholding the mutation. Learned advocate appearing for the petitioners submits that separate individual flats in selfsame building have been mutated but the application of the petitioners has not been considered.
Learned advocate appearing for the Municipality submits that the application will be taken up for consideration shortly.
As it appears that the application for mutation is pending before the Municipality for a considerable
period of time, accordingly, the instant writ petition is disposed of by directing the Municipality to take a decision with regard to the application for mutation filed by the petitioners in accordance with law, at the earliest, but positively within a period of six weeks from the date of communication of this order.
In the event any deficiency is found in the application, the same shall be immediately communicated to the petitioners for rectification. If the documents submitted by the petitioners are proper, then necessary consequential steps for mutating the property in the name of the petitioners shall be taken by the Municipality.
A decision shall be taken and communicated to the petitioners within the time as specified hereinabove. The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
