Learned Advocate appearing on behalf of the State has submitted a report in connection with Pukhuria P.S. Case No.44/2025 dated 16.01.2025. The report reflects that the investigating agency on conclusion of investigation has submitted chargesheet being Pukhuria P.S. CS No.397/2025 on or about 23.08.2025.

In view of the investigation having been concluded and the petitioner approaching this Court for proper investigation, I am of the view that the petitioner will address his grievances before the jurisdictional Magistrate in seisin of Pukhuria P.S. Case No.44/2025 in case any application is referred under Section 173(8)/193 of BNSS, 2023.

The learned Magistrate would assess and ascertain the contents of the application and try to dispose of such application within a period of 45 days of filing of such application.

With the aforesaid observations WPA 16491 of 2025 is disposed of.

Report be submitted by the State be kept with the record.

Copy of the reported be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
