Heard the learned Advocates appearing for the parties. Petitioners are in custody for about 85 days. It is submitted they have been falsely implicated in the instant case.

Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record including the statements of witnesses recorded under Section 164 of the Code of Criminal Procedure.

Witnesses implicate the petitioners in the incident.

We have also examined the post mortem report and the expert opinion at page 204-206 of the Case Diary. Expert opinion shows the victim was brutally assaulted and thereafter hanged alive.

In view of the aforesaid incriminating materials, we are of the opinion this is not a fit case to grant bail to the petitioners. Accordingly, the prayer for bail of the petitioners is rejected.
