27.08.2024 rc/ct.no.34 Item No.62 CRR No.2823 of 2024 In the matter of : Mrs. Ananya Sinha Gupta .......Petitioner Mr. Jaganath Ganguly ...for the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of the application under Section 23 of The Protection for Women from Domestic Violence Act, 2005 (hereinafter referred to as "the Act of 2005") pending before the learned Judicial Magistrate, Bidhannagar, North 24- Parganas the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the matter. Learned counsel for the petitioner submits that the application under Section 23 of the Act of 2005 is pending since August 05, 2023.

In view of the above, the learned Trial Court is directed to dispose of the application under Section 23 of the Act of 2005 within one month from the next date of hearing fixed before him without granting any unnecessary adjournment to either party, in accordance with law.

The learned Trial Court shall also make all endeavours to dispose of the case being no. 2929 of 2023 pending before him as expeditiously as possible, in accordance with law. CRR No. 2823 of 2024 is disposed of accordingly.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
