The grievance of the petitioner in the present writ application is that in the Post Mortem report of the cousin brother of the petitioner, no exact date of death has been mentioned and as such, the concerned authorities are not in a position to issue the death certificate of the cousin brother of the petitioner.

The State/respondent has filed the report and submits that as per the report of Dr. Chittaranjan Bhattacharyya, the death of Mr. Arpan Das son of Pradip Kumar Das, aged about 32 years could have been occurred on 4-6 days prior to holding the Post Mortem examination i.e., in between September 30, 2020 to October 2, 2020 and accordingly, the doctor has opined that the date of death may be taken as October 1, 2020.

Considered the report submitted by the authority wherein the doctor has opined that the date of death may be taken into consideration as October 1, 2020.

In view of the above, the respondent no. 7, i.e., the Administrator Bally Municipality Office at Bally is directed to issue the death certificate of the deceased Arpan Das son of Pradip Kumar Das by showing the date of death as October 1, 2020 in terms of the report of the Dr. Chittaranjan Bhattacharyya.

The respondent no. 7 is directed to issue the death certificate of the deceased to the petitioner within a period of two weeks from the date of receipt of this order. 6.

The State/respondent is directed to circulate the copy of the report to the respondent no. 7 as well as the counsel for the petitioner.

Accordingly, WPA 16412 of 2025 is disposed of. 8.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
