Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of cognizable offence being made out, no steps have been taken by the police authorities and repeatedly the police authorities have been informed by the present petitioner.

State has submitted a report. Report reflects that the registered deed of sale is of the year 2011. Substantial time has passed as the first of the information was on July, 2025.

Having considered that the police authorities were not sitting tight over the issue, but with lapse of time it was found that the person who executed the sale deed has expired.

Without entering into the same, I am of the view that since the police authorities according to the petitioner did not respond, petitioner would better be advised to approach the jurisdictional

Magistrate under the relevant provisions of Section 175(3) of the BNSS. Learned Magistrate will assess and ascertain regarding the genuinity of the allegations and thereafter pass necessary orders as he deems fit and proper.

With the aforesaid observations WPA 16489 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
