Learned advocate appearing for the petitioner submits that, the petitioner is the owner of a building in respect of which the Kolkata Municipal Corporation (KMC) complains of unauthorised construction. The petitioner complied with the notice issued under Section 41(A) of the Code of Criminal Procedure.

State is represented.

It appears that, KMC initiated proceedings under Section 401A of the KMC Act, 1980 as against the petitioner amongst other persons.

Considering the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 3658 of 2022 is dismissed.
