Lahiri Ms. Subhra Nag ...for the State The grievance of the petitioner is directed against non-consideration of the representation dated May 14, 2024. It is alleged on behalf of the petitioner that despite the petitioner having carried out all necessary works in terms of the subject tender, the respondent authorities and more particularly the concerned Zilla Parishad, being the respondent no.3 herein, has failed to make necessary payments to the petitioner.

In this background, the petitioner has been compelled to make a representation dated May 14, 2024 but the same remains unanswered till date.

The State is represented and submits that it has no objection to consider the representation in accordance with law.

In view of the above, WPA No.17511 of 2024 stands disposed of by directing the respondent no.3 to consider and dispose of the petitioner's representation dated May 14, 2024 in accordance with law and within six weeks from the date of communication of this order after giving a right of hearing to all the parties.

It is made clear that there has been no adjudication on the merits of the case and the respondent no.3 is to act strictly in accordance with law without being influenced by any observation made in this order and after hearing all the parties. Since no Affidavit has been called for, the allegations contained in the writ petition are deemed not to have been admitted.
