The learned advocate for the petitioner is granted liberty to amend the cause title.
Mr. Karmakar, learned advocate appearing for the petitioner draws the attention of the Court to the earlier order passed by this Court on 18.08.2017 in CRR 484 of 2017 wherein this Court directed the husband to pay interim maintenance at the rate of Rs.6000/- per month to the wife and Rs.4000/- per month to the minor daughter. Learned advocate submits that till date, the lady or the child has not received a farthing from the husband/opposite party no.2. Learned advocate further submits that execution cases have been filed and neither the distress warrant or the warrant of arrest so issued resulted in any fruitful result. The petitioner also expresses frustration regarding the attitude of the police authorities who were directed to execute the warrant of arrest by the learned Judicial Magistrate, 3rd Court, Tamluk. Having regard to the fact that the Misc. Execution Case is of the year 2017 and till date, the police authorities could
not execute the warrant of arrest, I direct the Superintendent of Police, Purba Medinipur to form a team of three officers who would work out regarding the whereabouts of the opposite party no.2, furnish details before the learned Judicial Magistrate, 3rd Court, Tamluk and exhaust all efforts for producing him before the learned Judicial Magistrate, 3rd Court, Tamluk within a reasonable period of time preferably by 15th February, 2023.
With the aforesaid observations, the revisional application being CRR 2731 of 2022 is disposed of. All pending connected applications, if any, are consequently disposed of.
