Learned counsel for the petitioner submits that although the application under Section 123 of the Domestic Violence Act has been disposed of, however, an appropriate may be issued for disposal for Misc. Case No. 254 of 2023 under Section 12 of Domestic Violence Act.

The court considers that no prejudice would be caused to either of the parties, if an appropriate direction is issued for the expeditious disposal.

Under such circumstances, learned Judicial Magistrate, 1st Court, Barrackpore, North 24 Parganas is directed to dispose of Misc. Case No. 254 of 2023 under Section 12 of Domestic Violence Act expeditiously in accordance with the law. 4.

Accordingly, CRR 3191 of 2025 stands disposed of. 5.
