The petitioner participated in a recruitment process initiated by the West Bengal Co-operative Service Commission vide advertisement no. 02 of 2020. The petitioner took part in the written examination on 28th February, 2021, but his name was not included in the list of candidates eligible for appearing in the interview conducted between 28th September, 2021 and 18th October, 2021.
It appears that by notification dated 10th January, 2022 the list of successful candidates whose names were recommended by the Commission for appointment to the various posts was published.
The petitioner submits that names of only 87 candidates were published whereas there were vacancies of 92 posts. The petitioner contends that he is confident that he performed very well in the written examination and he ought to have been permitted to appear in the interview.
Upon hearing the submissions made on behalf of the petitioner and on perusal of the materials on
record, it appears that the interview in question was held between 28th September, 2021 and 18th October, 2021. The petitioner being ineligible to participate in the interview did not challenge the result of the written examination. He neither questioned the action on the part of the Service Commission in not permitting him to participate in the interview.
The final list of successful candidates stood published on 18th January, 2022. The petitioner has filed the instant writ petition on 27th of July, 2022, that is, long after the selection process was over. It appears that, being unsuccessful in the written examination, the petitioner did not approach the Court in proper time.
Filing the writ petition after such a long delay and, that too, after publication of the final list of selected candidates, the prayer of the petitioner for production of the answer script in the absence of a formal application being made under the Right to Information Act, 2005 cannot be accepted.
The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
