Learned advocate for the petitioner submits that the petitioner is a witness in a previous police complaint against the mother-in-law of the de facto complainant and that the present police complaint was lodged in order to ensure that the petitioner is not in a position to be a witness in the previous police complaint. Learned advocate for the State draws the attention of this court to the statement under section 164 CrPC and to the medical report.

Considering the materials in the case diary, including the statement recorded under section 164 CrPC and the medical report, as also the gravity of the offences and the complicity of the petitioner therein, we are unable to grant anticipatory bail to the petitioner. CRM No.7292 of 2021 is thus dismissed.
