1. Mr. Ray, learned advocate appearing for the petitioner hands up to Court an order dated February 3, 2026 passed by the learned Judge, Bench-XIII, City Civil Court, Calcutta in Title Suit No.1799 of 2024 and submits that the aforesaid Title Suit has been dismissed for non-prosecution without any liberty to file a fresh suit on the selfsame cause of action. The copy of the aforesaid order handed up to Court is taken on record.

2. It is submitted that since the instant revisional application had been filed challenging an interlocutory order passed in the aforesaid Title Suit being Title Suit No.1799 of 2024, which itself has been dismissed, the present revisional application has become infructuous.

3. In such view of the matter, CO 2649 of 2025 is disposed of as having become infructuous. No costs.

4. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible.
