The allegation of the petitioners is of unauthorized construction by the private respondent over the government land.

An affidavit of compliance has already been filed before this Court.

Today a further report has been handed over by the Block Land & Land Reforms Officer, Ramnagar-I, Purba Medinipur wherefrom it appears that the order of the Court was duly complied by removing the illegal construction by demolishing the same on 9th February, 2022 in presence of the Joint Block Development Officer, Police Officer of Ramnagar-PS and Pradhan of Gobra Gram Panchayat.

The illegal construction of the house of Goutam Pradhan son of Nilkanta Pradhan from the part of the government land was removed on 9th February, 2022.

The petitioners submit that after removal of the said illegal construction, the private respondent that is Goutam Pradhan on 12th March, 2022 again started making illegal construction.

The petitioners lodged a complaint before the District Magistrate, Purba Medinipur. The same was enquired through the Block Development Officer, Ramnagar-I and the Revenue Inspector issued notice on receipt of the application of the petitioners for causing an inspection. The inspection was duly conducted wherefrom it appears that, as of now, there is no obstruction and/or construction in the government land.

The inspection was conducted on 4th May, 2022 on receipt of the application of the petitioner. As it appears from the aforesaid that the contemnor took necessary steps for compliance of the order passed by this Court, accordingly, no further order is required to be passed in the present contempt application.

The respondent authorities are directed to keep strict vigil so that further construction is not made by any party whatsoever encroaching the government land.

In the event there is encroachment in future, then necessary steps shall be taken in the matter on receipt of the complaint from the aggrieved party. The contempt application stands disposed of.

The instruction given by the Block Land & Land Reforms Officer, Ramnagar-I, Purba Medinipur dated 7th June, 2022 be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
