Mr. Anisur Rahman ...for the petitioner Mr. Jayanta Samanta Ms. Sinthia Bala ..for the State This is an application under Article 226 of the ssi Ct 14 Constitution of India alleging police inaction in respect of an FIR lodged by the petitioner being Samsherganj Police Station Case No. 25 dated 20.01.2023 under Sections 363, 365, 370, 420, 308, 385 read with Section 34 of the Penal Code.

Affidavit of service filed on behalf of the petitioner is taken on record.

Despite service, no one appears on behalf of the private respondents.

Report filed on behalf of the State is also taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's deaf and dumb elder sister was abducted by the respondent nos. 7 and 8. The petitioner lodged a missing diary and thereafter an

application under Section 156 (3) of the Code of Criminal Procedure pursuant to which the FIR was registered. However, the police authorities have not investigated the case.

Learned counsel appearing on behalf of the State submits that the police had already recovered the victim lady on 25.07.2023 and would be producing the lady before the learned Court today i.e. on 26.07.2023.

It appears that the police have been able to recover the victim lady who would be produced before the Court today. Thereafter, no further order need be passed in this writ petition.

Accordingly, the same is disposed of without costs. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
