The petitioner objects to the composition of the enquiry committee on the ground that Sri Goutam Roy, the Executive Engineer, PHE Directorate, Midnapore Division, would be a judge of his own cause. The petitioner had raised several objections against the said officer and his presence will prejudice the entire enquiry.

It is made clear that Sri Goutam Roy will not be a part of the three member enquiry committee in any capacity whatsoever. He will not be a part of the decision making process. Rather, he may be called as a witness for adjudication of the issues involved and specially with regard to the allegations made by the petitioner against him. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
