CRIMINAL MISCELLANEOUS JURISDICTION C.R.M. (DB) 2552 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure, 1973.

In the Matter of : Ghazala Nasreen .....petitioner.

Mr. Imran Sidique, Mr. Naved Arshi, Mr. Anirban Ghosh ...for the petitioner. Mr. Neguive Ahmed, Ms. Trina Mitra ...for the State. This case relates to ponzi scam in which the organisation S.B.F. Network Marketing is accused of being involved. The petitioner is alleged to be actively involved in collecting money for the organisation and mis-appropriating the same.

She is in custody for 52 days.

The facts are similar to those in C.R.M.(DB) 2407 of 2022 (Shabnam Parveen @ Shabbo and Anr. -vs- State) in which we granted conditional bail today to the petitioner. Here also investigation is complete. Charge-sheet has been submitted.

Mr. Ahmed, learned advocate for the State submits that the accused needs to be in custody to enable the respondents to trace the mis-appropriated fund and its application.

On the above facts, we grant one month's time to the respondent to conduct and conclude any further investigation.

On and from 19th September, 2022, the petitioner shall be enlarged on bail upon furnishing a bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional District Judge, 3rd Court, Alipore on the following conditions:

1. The petitioner shall deposit her passport with the investigating officer,

2. She shall report before the said officer as and when summoned,

3. The petitioner shall not leave the limits of city of Kolkata without informing the I.C.,

4. She shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever,

5. The petitioner shall attend the court on each and every day of trial, in default, the court shall be at liberty to cancel the bail bond without any reference to this bench.

The application for bail [CRM (DB) 2552 of 2022] is, accordingly, disposed of.
