IN THE HIGH COURT AT CALCUTTA

Item No.17 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 2590 of 2023 In the matter of : Savitri Properties Pvt. Ltd. ... Petitioner. Ms. Sayanti Santra, Mr. Amarnath Datta ... For the Petitioner.

The order dated 27.06.2023 passed in Criminal Revision No. 128 of 2018 reflects that the accused persons adopted a ploy to delay the proceedings under Section 138 of the Negotiable Instruments Act. The next date has been fixed on 26.07.2023. The learned sessions court, without any further delay in the proceedings, would complete the hearing of the revisional application on 26.07.2023 and try to pronounce his order within ten days thereafter. Needless to state that the revisional application is pending before the City Sessions Court, Bichar Bhawan, Calcutta for a period of more than five years. The subjectmatter of the complaint is a proceeding under Section 138 read with Section 141 of the Negotiable Instruments Act. The purpose of the Act was for efficacious remedy which was enacted for the sole purpose that the civil courts have failed to deliver the relief so expected in case of dishonour of cheques.

The complainant filed this case in the year 2015. More than eight years have passed since initiation of the complaint case. Learned revisional court will keep the same in mind while disposing of the revisional application within the schedule as directed above.

With the aforesaid observations, the revisional application being CRR 2590 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
