03.03.2022 Court No.13 Item No.27 AP WPA 17651 of 2021 Sri Nirmal Kumar Jana and Anr.

Vs.

State of West Bengal and Ors.

(Through Video Conference) Ms. Malabika Saha Mr. Subhankar Das ... For the Petitioners.

Mr. Lolit Mohan Mahata Mr. P. B. Mahata ... For the State.

The petitioner seeks quashing of FIR No.271/21 dated 29.06.2021, FIR No.302/21 dated 18.06.2021, FIR No.371/21, CDE No.1716 dated 08.05.2021.

Investigation has also been sought into the complaints of the petitioner that has been registered as FIR No.222/21 dated 22.04.2021 and FIR No.269/21 dated 26.05.2021.

Counsel for the State submits that several charge sheets have been filed in respect of the FIRs registered at the instance of the petitioner and against them. In that view of the matter, prayers 'a' and 'b' of the writ petition have been rendered infructuous. In so far as a prayer made by the petitioner to allow her to complete a construction of a boundary wall, it appears that the same is outside the scope of the writ petition and cannot be entertained.

I.C. Bagnan Police Station has already stated in his report dated 7th February 2022, that he shall ensure strict vigil over the said disputed area and also ensure that there is absolutely no breach of peace thereat. With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
