Learned counsel for the petitioners submits that the tenancy of the petitioners in respect of the said godown has been recognized by the competent Civil Court and, therefore, they are entitled to obtain a separate electricity connection. It is further submitted that the Calcutta Electric Supply Corporation Limited (CESC) has already accepted the requisite charges for effecting such connection.

Learned counsel appearing for CESC submits that the petitioners' request can be considered after conducting an inspection of the premises.

A prayer for adjournment has been made on behalf of respondent no. 5; however, such prayer is rejected having regard to the nature of the dispute. Upon consideration of the submissions, I am of the view that the petitioners, being in settled possession of the godown in question, are entitled to a separate electricity connection. Needless to mention, grant of electricity connection does not confer any right, title, or interest over the property in question. Accordingly, CESC is directed to conduct an inspection, if necessary, with police assistance. The police shall be at liberty to break open the padlock of the meter room for the purpose of facilitating the inspection, and the petitioners shall bear the cost of such police assistance.

Upon completion of the inspection, and based on its outcome, CESC shall provide the electricity connection to the said godown. It is further clarified that this connection shall be granted without prejudice to the rights and contentions of the parties in Title Suit No. 685 of 2025, pending before the learned Civil Judge (Junior Division), 2nd Court at Howrah.

The entire exercise shall be completed within a period of six weeks from the date of this order, subject to the petitioners' compliance with all necessary formalities.

Accordingly, WPA 16325 of 2025 is disposed of.
