CRIMINAL MISCELLANEOUS JURISDICTION CRM (NDPS) 1097 of 2024 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure, 1973, in connection with Special Case No. 83 of 2021 arising out of English Bazar Police Station Case No. 1154 of 2021, dated 08.09.2021 under Sections 21(c)/29 of the NDPS Act, 1985.

The petitioner renews his prayer for bail. He says that he is in custody for about two years and 10 months. Learned Advocate for the State, in his usual fairness, places before us the FSL report. The report is negative. In other words, the sample was found not to contain any narcotic drugs or psychotropic substance.
In view of the aforesaid, we allow the petitioner's prayer for bail.
Accordingly, we direct that the petitioner, namely, Amanatullah Khan, shall be released on bail upon furnishing a personal bond of Rs.10,000/- (Rupees Ten Thousand), to the satisfaction of the learned Judge, Special 3rd Court under N.D.P.S. Act, Malda subject to condition that the petitioner shall appear before the Trial Court on each and every date of hearing Signed By :

until further orders and shall not intimidate the witnesses or tamper with evidence in any manner whatsoever. In the event the petitioner fails to adhere to any of the conditions stipulated above without any justifiable cause, the learned Trial court shall be at liberty to cancel the petitioner's bail in accordance with law without further reference to this Court.
The application for bail being CRM (NDPS) 1097 of 2024 is accordingly disposed of.
Criminal Section is directed to supply urgent photostat certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
