Petitioner seeks cancellation of the order granting bail dated October 8, 2021 passed by the learned magistrate. State and the private opposite party are represented. The learned magistrate while grating bail on October 8, 2021 considered the nature of allegations and proceeded to grant bail.

Accordingly, the learned magistrate considered the case diary and, thereafter, proceeded to grant bail in favour of the private opposite party.

There is no allegation of post bail misconduct. In the peculiar facts and circumstances in the present case, we are unable to interfere with the order granting bail. Consequently, CRM 7299 of 2021 is dismissed.
