The petitioner is aggrieved that the private respondents' construction over an irrigation canal of PWD land is likely to cause serious damage to their livelihood as such canal feeds the agricultural activities of the petitioner and other villagers. Counsel for the State submits that ever since notice of the writ petition and the inspection conducted by Mathurapur Police Station, no further construction is going on.
Mathurapur Police Station shall ensure that there is no construction on any PWD land or canal in any form.
Let a notice of this order be served on the Executive Engineer, PWD and Mathurapur Police Station for necessary action in the matter.
With the aforesaid observations, the instant writ petition shall stand disposed of.
There will be no order as to costs.
