Learned advocate appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that, pursuant to the petitioners' application for an electricity connection, a site survey was conducted. During the survey, it was found that two poles were required to be installed in a passage. However, due to objections raised by respondent nos. 4 and 5, the poles could not be installed.

Despite service of notice, respondent nos. 4 and 5 are not represented before this Court.

Mr. Mukteswar Maity, learned advocate for the petitioners, has drawn the attention of this Court to an order of injunction passed in Title Suit No. 682 of 2018, whereby the learned Civil Judge (Junior Division), 1st Court at Barasat, 24 Parganas (North),

restrained respondent nos. 4 and 5 from obstructing petitioner no. 1 in the use of the said passage. Since the settled possession of the petitioners over the relevant property is not disputed before this Court, I am of the considered view that the petitioners are entitled to receive the electricity connection. Accordingly, this writ petition is disposed of with a direction upon WBSEDCL to effect the electricity connection at the petitioners' premises with the assistance of the local police, within a period of six weeks from date, subject to compliance by the petitioners with all necessary formalities.

The petitioners shall bear the cost of police assistance, if required.

The connection shall not have any bearing on the pending Civil Suit between the parties.

Accordingly, WPA 16550 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
