Learned Advocate appearing for the petitioner submits that considering the medical condition of the petitioner and considering the nature of the offence alleged against the petitioner and considering the fact that two other co-accused were granted anticipatory bail, the prayer for anticipatory bail for the petitioner should be allowed.

State and the de facto complainant are represented. Learned Advocate appearing for the State submits that the original deed of gift is yet to be seized. He submits that the petitioner is beneficiary under the forged deed of gift. Considering the materials in the case diary and considering the fact that the petitioner is the beneficiary of a deed of gift which is claimed to be foraged and considering the fact that deed of gift is yet to be seized by the investigating authority, we are not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected. CRM 7301 of 2021 is, accordingly, dismissed.
