Heard learned counsels for the parties.

The petitioner is in custody for about 81 days and prays for bail.

Learned counsel for the petitioner submits that there was no pre meditation on the part of the petitioner in the alleged incident. The incident occurred on the spur of the moment. Charge sheet has been submitted.

Learned counsel for the State opposes the prayer. I have considered the material on record. It appears that the petitioner is the full blood brother of the victim and there was a property dispute between them. The petitioner assaulted the victim with a wooden stick. The victim succumbed to his injuries. The offending weapon was recovered at the instance of the petitioner. Charge sheet has been submitted. Witness action is yet to commence. Considering the material on record and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
