18.07.2023 sdas rejected C.R.M.(DB) No. 2850 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kotwali Police Station Case No. 231 of 2012 dated 05.04.2012 under Sections 363/366A/372/34 of the Indian Penal Code.

And In Re : Hilal Sk. & Ors. .... petitioners Mr. Partha Pratim Das Mr. Amanul Islam Mr. Sourav Mukherjee ....for the petitioners Mr. Ranabir Roy Chowdhury Mr. Mainak Gupta ...... for the State Learned Counsel for the petitioners submits they have not been named by the victim under Section 164 of the Code of Criminal Procedure. They renew their prayer for bail. Learned Counsel for the State opposes the prayer for bail and submits petitioners had absconded for more than ten years.

We have considered the materials on record. Case involves trafficking of victim for sexual exploitation. Petitioners had absconded for more than a decade. Vulnerable witness is yet to be examined. Under such circumstances we do not consider it prudent to enlarge the petitioners on bail. The application for bail is, thus, rejected.
