The petitioner applied for licence of FPS dealer in term of notification no. 1934 o/SCJ/FRK/316/2022 dated 29.11.2022.

It is the case the petitioner that after submission of the application, the proposed shop cum godown was not inspected by the concerned authority. He submitted one representation to the authority, in terms of his submission, one hearing was conducted during pendency of the writ petition on July 11, 2024. He prayed for necessary order, so, that proposed shop cum godown may be inspected and the procedure of the said notification may be ended to its logical conclusion. Having heard, learned counsel for the petitioner, it appears to me that the petitioner has applied for licence for making specific application. It further appears that the authority concerned has not proceeded to carry out the directives of the notification as yet.

Considering the same, I think it is necessary to dispose of the writ petition by passing certain direction upon the authority concerned.

Under the above observation, the writ petition is disposed of with a direction to the Sub-divisional Controller, Food and Supply Jangipur, being respondent no.5 of the writ petition to proceed with the selection process in terms of notification and according to the provisions of Control Order, 2013, so that the entire procedure of vacancy may be ended to its logical conclusion.

I make it clear that the SCFS concerned shall conclude the procedure according to the directive of law and in terms of direction of the Hon'ble Division Bench of this Court passed in MAT 1543 of 2024.

Accordingly, this writ petition is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
