The Chairman of Joynagar Mazilpur Municipality has given instruction to the learned advocate wherefrom it appears that the Municipality has taken a stand not to remove the 'Chala' (temporary shed) lying in the Hat.
The notice which is under challenge in the present writ petition, has categorically been withdrawn and the same is clearly mentioned in the instruction forwarded by the Chairman of the said Municipality. As the impugned notice stands withdrawn as per the instruction of the Chairman of Joynagar Mazilpur
Municipality, accordingly, there is no requirement of proceeding with the writ petition any further. The grievance of the petitioner has already been redressed by the Municipality.
The instruction given by the Chairman of the Joynagar Mazilpur Municipality dated 10th August, 2022 be retained with the records.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
