Order dictated by Partha Sarathi Sen, J.:

It is submitted on behalf of the petitioner that the present accused-petitioner has been implicated in this case out of mere suspicion and the present accused-petitioner has got no role in the alleged crime.

Per contra, learned Advocate for the State submits before this Court that though the instant case is based on circumstantial evidence but those circumstances are very strong and create complete chain, at least prima facie to entangle the present accused-petitioner with the alleged crime.

On perusal of the materials as placed before us, we are convinced with the submission of learned Advocate for the State since we find sufficient incriminating materials as against the present accused petitioner which have been collected in course of investigation at least, prima facie.

Considering the entire circumstances, we are not at all inclined to exercise our discretion under Section 439 Cr. P. C. in favour of the petitioner, at this stage.

CRM (DB) 2151 of 2024 is, thus, dismissed.
