The petitioner has grievance against the private respondent that certain sums of money to the extent of Rs.4,57,000/- are still due and payable. Complaint has been lodged in the Garfa Police Station in this regard. The Officer-in-Charge, Garfa Police Station filed a report dated 30th January, 2023. The Officer-inCharge, Survey Park Police Station also filed a report dated 3rd February, 2023. The Officer-in-Charge, Kolkata Lether Complex Police Station filed a report dated 1st February, 2023. All the abovementioned reports are taken on record.

It appears that arbitration proceedings under the Act of 1996 are pending between the petitioner and the private respondent.

The dispute is purely civil in nature and the Survey Park Police Station has rightly not registered FIR in the matter after due enquiry.

The petitioner may agitate his grievances against the private respondent in the pending arbitration proceeding or any other civil proceedings he may take out in accordance with law.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
