The petitioner is aggrieved by the fact that in spite of Shyampukur P.S. Case No. 79 dated 03.08.2024 having been registered for investigation, yet the case has not progressed though almost one year has expired since the registration of the FIR. The petitioner complains of his signature being forged.

Having considered the plight of the petitioner and the submissions advanced on behalf of the State that there has been non-cooperation on behalf of the respondent no.5, I direct that if further inconveniences are faced by the investigating agency, they would add Section 120B of Indian Penal Code or Section 61(2) of BNS, 2023 and take

steps against the erring officials of the Insurance Company who are not cooperating.

Needless to state that since no affidavits have been exchanged, the allegations and/or accusations made in the writ petition are deemed not to have been admitted.

With the aforesaid observations, the writ petition being WPA 16551 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
