Learned advocate appearing for the petitioner highlights the period of detention of the petitioner. He submits that, the petitioner was falsely implicated. He highlights the arrest procedure of the petitioner.

Learned advocate appearing for the State submits that, 26.7 kgs. of 'ganja' was seized from the joint possession of the petitioner.

Considering the materials in the case diary and considering the fact that commercial quantity of narcotic was seized from the joint possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant bail to the petitioner.

Accordingly, prayer for bail of the petitioner is rejected and the application being CRM 7306 of 2021 is dismissed. (Debangsu Basak, J.) (Ananda Kumar Mukherjee, J.)
