Mrinal Kanti Prodhan v. Burn Standard Co. Ltd.
16.09.2021 Sl. No.18 List - D/L Mithun Ct.No.09. WPA/16315/2003 Mrinal Kanti Prodhan Vs.
Burn Standard Co.Ltd. & Ors.
(Via Video Conference) The instant writ petition has been filed in the year 2003 alleging a grievance by the writ petitioner that the respondent authorities withheld the Provident Fund dues of the petitioner after he was removed from his job due to closure of Gulphabari Works station under Burn Standard Company Limited being a subsidiary unit of Bharat Bhari Udyog Nigam Limited, a Government of India undertaking.
It appears from the order dated 28th January, 2004 passed by a Coordinate Bench that the petitioner accepted a cheque of Rs.42,833.89 towards Provident Fund dues in open Court. Since then he has not taken any step in the instant matter.
There is every reason to hold that, the amount as a result of conspicuous absence of the petitioner, the petitioner has received the entire amount of P.F. dues from his employer.
In view of such circumstances, the instant writ petition is dismissed.
