D.Hira None appears on behalf of either of the parties. This matter is pending in the list since 21.04.2023 and has been called on each day of working of this Court since that date. In spite of that no one is appearing. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit. Order of the Judicial Magistrate, 7th Court at Asansol, District Burdwan dated 27.04.2016 passed in Misc. Case No. 403 of 12015 is under challenge in this case.

The Magistrate, by dint of the said order has allowed the application of the opposite party/wife or interim maintenance, directing the petitioner to pay a sum of Rs.4,000/- per month to the wife and Rs.2,000/- per month to the minor child, as maintenance. According to the petitioner, the order as above of the Magistrate is not sustainable in view of the fact that it is not in conformity with the settled legal position governing the field.

On perusal of the entire materials available on record and the grounds made up by the petitioner I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this Court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 2435 of 2016 is dismissed. All pending applications, if any, are consequently disposed of.
